Shaping Public Discourse on Controversial Issues
Challenges:
As the result of a family dispute, one of the Indonesia´s largest wood processing manufacturers was challenged by legal uncertainty issues caused by the abuse of power from one of the country´s most powerful enforcement agencies. The case was politicised by individuals within the institution by leveraging negative media campaign.
Our Approach:
Due to the sensitive nature of the case, our litigation communication approach was focused garnering third-party support by shaping public dialogue regarding institutional reform. This controversial issue emerged as the result of our analysis that shows significant indirect correlation with our client´s concern. We worked closely with a team of lawyers representing the client to formulate strategies and execute various litigation communication programs. A series of opinion articles endorsed by legal experts and public service observers were published in conjunction with other programs, such as round table discussions, press conferences, and TV talk shows.
The Outcome:
In line with the succession of the Chief of this enforcement agency, the case was settled out of court. The issue of institutional reform instigated a new measure of investigation that limits external intervention in influencing the case.
Turning Third-Party Advocates into Ambassador
Challenges:
A little awareness on issues that perceive dormant by public has hindered our client´s merger and acquisition (’M&A’) objectives. Our client had an inferior bargaining position on commercial terms during the M&A negotiation. Ironically, these issues have been causing economic loss for both the country and consumers.
Our Approach:
We formulated a comprehensive communication plan to raise the awareness and revitalise public attention on the issues. Given the breadth of these issues has relevance with many subjects; we turned to third-party advocates -- leaders from each discipline -- into ambassadors of sub-issues that implicitly integrate with the main concern. We utilised academic research from different disciplines that proves the dominant position of our client’s opponent. We leveraged an extensive media campaign to sustain the attention from public, enforcers, and policy makers.
The Outcome:
Our client´s position is getting stronger subsequent to the newly enforced regulation that limits its opponent´s span of commercial control. The M&A negotiation was eventually revived with significant advantages at our client´s end.
